Probate, triggered by the passing of an individual, is the process by which the court system oversees the legal transfer of assets from the deceased to their legal beneficiaries or heirs. Through this process, the court verifies the validity of a will, designates an agent to manage the estate, distribute the property, and pay the deceased's taxes and debts, if any.
This is a public process and—while it is possible to forego entering probate court with the proper estate planning— we are here to make the process as pain-free as possible.
Can the Estate Still Enter Probate Even with a Trust?
Even with a trust in place, probate may still be initiated if the deceased's assets were not properly titled in the name of the trust. It is crucial to keep your estate plan up to date as your life, assets, and family structure change. We recommend reviewing and updating your Estate, Trust, & Legacy Plan to account for changes to your life or every three years.
